1. Initial provisions

1.1 - These Multicurrency Service Specific Terms ("Multicurrency Terms") set forth the legally binding terms and conditions for use of the Multicurrency Service by the Partner.

1.2 - These Multicurrency Terms are published on the Mews website and form an integral part of the Agreement.

1.3 - This version of the Multicurrency Terms is valid and effective from the Multicurrency Terms Effective Date as stated above. 

2. Definitions

2.1 - Any capitalized terms not defined in these Multicurrency Terms shall have the meanings defined in the Merchant Terms or Master Terms and Conditions.  

2.2 - The headings and structure of these Multicurrency Terms, as well as any examples provided under certain clauses, if any, shall not affect their interpretation. 

2.3 - In the event of any discrepancies between these Multicurrency Terms and Master Terms and Conditions, these Multicurrency Terms prevail in relation to the use of Multicurrency Service. 

Account Holder. Means any person who is authorised to use any payment method or financial service issued or provided to him/her. 

Customer. Means person requesting, being provided, or having been provided with Partner Services regardless of whether or not registered with Mews Platform. 

Customer Home Currency. 

  1. For Transactions: Is determined by the Customer's browser geolocation
  2. For Point of Sale (POS) Transactions: Is the default currency as determined by the Account Holder's payment card Bank Identification Number (BIN).

 

Base Exchange Rate. Is the rate indicating the value of one currency for the purpose of conversion to another as determined by the Payment Services Provider.   

Customer Exchange Rate. The rate applicable to the Customer at the time of the Transaction or POS Transaction, consisting of the Base Exchange Rate increased by the Markup Fee.  

Facility. Means hotel, hostel or any other facility operated by the Partner as specified in the Agreement.  

Markup Fee. Represents the percentual adjustment of the Base Exchange Rate to reflect the expense for the Multicurrency Service.  

Mews Markup. Is a portion of the Markup Fee which is paid to Mews for each Multicurrency Transaction. 

Partner. Means accommodation or other services provider or any other entity using the Mews Platform, based on the Agreement with Mews or use of Services provided by Mews.  

Partner Commission. Is a portion of the Markup Fee which is paid to the Partner for each Multicurrency Transaction.  

Payment Services Provider. Means payment services provider identified in the Merchant Agreement.   

Payment Services Provider Fee. Is a portion of the Markup Fee that is charged by the Payment Services Provider for providing the Multicurrency Transaction.  

Point of Sale (POS) Transaction. Means Transaction submitted for processing by a cardholder via POS terminal where the card is physically swiped or tapped through a reader or EMV chip is processed at the time of the Transaction.  

Stripe. Means Stripe Inc., a Delaware corporation and/ or Stripe Payments Company or other Stripe’s Affiliate(s) as the case may be.  

Transaction. Means authorisation request of Account Holder for a Payment from the Account Holder to Partner submitted by Partner to Payment Services Provider and/or Member (as applicable).  

3. Subject Matter

3.1 - Simplification of International Payments 

Multicurrency Service enables Partners to offer to their Customers through the Payment Services Provider the option to pay in their local currency during online bookings or in-person transactions under the terms and conditions set forth herein ("Multicurrency Service"). Any Payment Processing Services are provided directly by the Payment Services Provider. 

 3.2 - Eligible Payment Services Provider 

Multicurrency Service is only available to Partners whose Payment Processing Services are provided by Stripe as their Payment Services Provider and who have a valid and effective related Sub-Merchant Agreement.  

 3.3 - Mews Services 

The Multicurrency Service shall be considered as “Mews Services” defined in the Master Terms and Conditions. 

 3.4 - Availability

     3.4.1 - Multicurrency Service will only be available:

  1. if the Customer selects to pay in the Customer Home Currency and only for the currencies listed here; and 
  2. for any Transaction or Point of Sale (POS) Transaction as defined in the Merchant Terms.  

     3.4.2 - The Partner acknowledges that the list of currencies may change based on the currency availability of the applicable Payment Services Provider.  

 3.5 - Territory 

Multicurrency Service is available for Partners whose Facility is located in the European Economic Area, Switzerland and United Kingdom. Mews may expand or withdraw the availability of the Multicurrency Service to additional locations at its discretion and without prior notice. 

 3.6 - Applicability  

The Multicurrency Service is available to all Partners who fulfil the relevant requirements set out in these Multicurrency Terms and who comply with the terms of their applicable Merchant Agreement and Sub-Merchant Agreement.  

 3.7 - Supported Payment Terminals 

Multicurrency Service for Point of Sale (POS) Transactions are available on Mews Terminals S1 and S2 and are limited to countries where Mews Terminals S1 and S2 are officially available ("Supported Mews Terminals"). The current list of Mews Terminals and of the available countries for the Supported Mews Terminals can be found here. Mews reserves the right to modify the list of the Supported Mews Terminals and the available countries at its discretion and without prior notice. 

 3.8 - Compatibility with other services 

Multicurrency Services via the Supported Mews Terminals are compatible with Mews Operations and Mews Kiosk only. Multicurrency Services are not compatible with Mews POS Services. Mews may extend compatibility to additional services at any time without prior notice. 

4. Partner Obligations

4.1 - The Partner agrees to comply with all applicable laws relating to the use of the Multicurrency Services, including updating its terms and conditions for Customers and informing them that their bank or card issuer may charge a foreign transaction fee. The Partner must inform its customer of the likelihood of foreign transaction fee being charged by the Customer's bank issuer. The Partner may e.g. display the following sentence on its Mews Payment Platform: “Your card issuer may charge the guest a foreign transaction fee which is not reflected in the price.” 

4.2 - Partner agrees to use the Multicurrency Service in compliance with Partner’s relevant agreements with Mews and Payment Services Provider. Partner may only use Multicurrency Service in connection with its acceptance of payments from its customers made in exchange for goods or services in connection with its business. 

5. Fees and Rates

5.1 The Partner agrees that any payments under these Multicurrency Terms will be processed via the Sub-Merchant Account.

5.2 Base Exchange Rate

The exchange is processed by the Payment Services Provider. Base Exchange Rate is determined by the Payment Services Provider at the time of the Transaction or the POS Transaction, Refund or Chargeback and cannot be modified by Mews or the Partner. The Base Exchange Rate fluctuates in time and therefore may differ for Transactions and for POS Transactions. The Base Exchange Rate will not be displayed to the Customer.

 

5.3 Markup Fee

  • 5.3.1 Markup Fee is determined by Mews in the Agreement to reflect the expenses to provide the Multicurrency Service. Markup Fee is paid by the Account Holder and consists of the Partner Commission, Payment Services Provider Fee and Mews Markup.
  • 5.3.2 The Markup Fee is calculated as fixed rate (%) as specified in the Agreement.
  • 5.3.3 The Markup Fee for Transactions differs from the Markup Fee for POS Transactions.
  • 5.3.4 The Markup Fee will not be displayed to the Customer as a separate fee. Instead, it will be embedded into the Customer Exchange Rate, which will be displayed to the Customer at the time of the Transaction or POS Transaction.

6. Refunds and Chargebacks

6.1 - The Partner agrees that in the event of a Refund or a Chargeback, the Partner shall ensure that the Customer must always receive the exact amount originally paid for the Transaction or POS Transaction in the same currency in which the Customer originally paid. The Partner acknowledges that the Base Exchange Rate might be different at the time of Transaction or POS Transaction and Refund or Chargeback. Any such Refunds or Chargebacks must be carried out via the Partner's Sub-Merchant Account. 

 

6.2 - The Partner acknowledges that in the event of a Refund or Chargeback (i), the Mews Markup and the Payment Services Provider Fee related to the original Transaction or POS Transaction will not be refunded and shall be retained by Mews and the Payment Services Provider, respectively ; and (ii) the Partner bears the risk related to the Base Exchange Rate fluctuation. 

7. Miscellaneous

7.1 - Changes to the Multicurrency Terms 

These Multicurrency Terms may be changed from time to time by Mews. If Mews makes a change to these Multicurrency Terms, Mews will inform the Partner at least thirty (30) calendar days before the changes take effect, unless change to the Multicurrency Terms is required by applicable law, in which case shorter or no notice may apply. Partner's continued use of the Multicurrency Services after the effective date of any update or modification constitutes acceptance of the updated Multicurrency Terms. Partner further agrees that updates or modifications do not require additional signatures or express acceptance beyond continued use of the Multicurrency Services after such effective date.  Notwithstanding the foregoing, Mews may update the Multicurrency Terms without notice to reflect: (a) the addition of new locations under Section 3.5; (b) the addition of new Supported Mews Terminals or available countries under Section 3.7; and (c) the extension of compatibility to additional services under Section 3.8.
